New Delhi, 25 June 2021: The Supreme Court on Friday quashed the June 9 order of the Kolkata High Court in the Narada scam case. It has also directed to file an application in the High Court by Monday, June 28.

Chief Minister Mamata Banerjee and Law Minister Moloy Ghatak had challenged the order. The high court had refused to take the Bengal government’s affidavit on record while hearing the CBI’s transfer petition in the case.

The case relates to the role of the Chief Minister and Law Minister during the arrest of four Trinamool Congress (TMC) leaders by the CBI in the Narada scam.

A vacation bench of Justices Vineet Saran and Dinesh Maheshwari urged a five-member high court bench headed by acting Chief Justice Rajesh Bindal to reconsider the applications of Mamata and Ghatak. Earlier the hearing would have started on Tuesday, justice Aniruddha Bose has dissociated himself from hearing the case. The matter was then placed before Chief Justice NV Ramana.

The matter then came up for hearing before a bench of Justices Vineet Saran and Dinesh Maheshwari. Justice Saran adjourned the hearing terming the case as new to his bench. He had urged the high court not to hear before June 25.

Three appeals are pending in the Supreme Court against the Calcutta High Court’s June 9 order. Two appeals have been filed on behalf of the Bengal government and Law Minister Moloy Ghatak in which the high court refused to take on record the affidavit filed by Mamata Banerjee and the constituent in the CBI transfer petition.

The third petition has been filed by Mamata Banerjee herself in the Supreme Court and challenged the high court order. The case relates to the role of Mamata Banerjee and Ghatak at CBI arrest of Trinamool leaders in Narada scam on May 17.
