Patna, 17th May 2022: Bihar Government will soon shut down coaching institutes running across the state. All the institutions will have to be registered with the state government in any case for operation.
All the facilities have to be provided as per the prescribed standards. Along with this, the team of qualified teachers, necessary infrastructure will have to be kept for all the courses. The coaching institutes will have to inform the state government about the fee for the courses conducted at the time of registration application itself.
Bihar Coaching Institute (Control and Regulation) Act 2010 is applicable to control private coaching institutes in the state. After the approval of the State Cabinet, both the Houses of the Legislature and the Governor, this Act was published in the Bihar Gazette on 28 April 2010 and has been in force since then. But till now the rules were not made to implement this act. After 12 years of enactment, now its exercise has intensified.
The Education Department has prepared the Bihar Coaching Institute (Control and Regulation) Rules 2022. It has been published on the departmental website http://state.bihar.in//educationbihar.
The Director of Secondary Education, Manoj Kumar has issued a general notice for all the stakeholders regarding the draft of the manual issued under the signature of the Additional Chief Secretary, and has sought suggestions by May 31. Anyone can give their suggestions on the e-mail id of Director Secondary at directorse.edu@gmail.com.
Running coaching without registration will be a crime, according to the proposed rules, running coaching without registration or its renewal (after three years of registration) will come under the category of offense.
Further, contravention of the specifications of the Act or any other provision shall be an offense as per the Rules. For violation of any provision of the Rules or the Act, the registration will be canceled for the first offence, 25 thousand for the first offence, 1 lakh for the second offence, and after giving cause and opportunity of being heard.
A four-member committee will take decision on registration, SDO will do site check: All DMs will constitute registration committee within 15 days of implementation of rules. It will have itself DM, SP, DEO and principal of an incorporated college.
The DM also has to form an inquiry committee within 15 days of the formation of the rules. The investigation will not be done by officers below the level of DM or SDO. In the rules, provisions for complaint, hearing and appeal against coaching institutes and their fees will also be fixed.
